Terms of service

The short version

  • These terms are the agreement between you and Lorenzo De Poli, who runs Delirium of Traders in Italy. You accept them when you create an account.
  • The Free plan is open, with no time limit. Pro and Elite are not on sale yet: you can join a waitlist with a free account, which costs nothing and commits you to nothing.
  • Before we sell anything, we will publish updated terms on prices, payment, renewal, cancellation and the 14-day right of withdrawal for EU consumers. You will see them before you buy.
  • Your journal is yours: no other user sees it, we look at it only when it is needed to run the service, and the AI features send our AI provider only what they need. You can export all of it as a JSON file, or delete your account, whenever you want.
  • On Pro and Elite, Autosync brings your trades in by reading only the fill files DeepCharts saves on your computer: no broker password, no connection to your broker, no orders.
  • This is a journaling and analytics tool, not financial advice. It gives no trading signals, AI answers can be wrong, and your trading decisions and their results are yours alone.
  • Italian law applies, and nothing in these terms takes away the rights consumer law gives you.

1. Who we are and what these terms cover

Delirium of Traders is a trading journal for futures traders, run by Lorenzo De Poli in Italy. In these terms, “we” and “us” mean Lorenzo De Poli, the provider of the service, and “you” means the person who uses it.

These terms cover the website at deliriumoftraders.com, the journal web app and the Windows desktop widget (together, “the service”). They are the contract between you and us. How we handle your personal data is explained in the Privacy policy: it is information the GDPR requires us to give you (Articles 13 and 14), not a contract you sign.

You accept these terms when you create your account, whichever way you do it: with email and password, or with “Continue with Google”, including when Google creates your account from the sign-in page. If you do not agree, please do not create an account. The contract is these terms: we do not keep a separate copy for each user, so save or print this page if you want to keep it. Until you send the sign-up form, you can check and correct anything you typed in it, and you can conclude the contract in English or in Italian (section 20). If you only visit the website, section 12 still explains what the site is and is not.

If the business behind Delirium of Traders moves to a company set up by Lorenzo De Poli, we may transfer this contract to that company, telling you by email in advance. Your rights stay the same, and if you do not agree you can delete your account before the transfer.

2. The service

The service has three parts, and its features evolve over time (section 13).

  • The website at deliriumoftraders.com.
  • The journal, a web app you use in your browser: dashboard and statistics, trade journal, diary, setups, accounts, the Prop Tracker with its Monte Carlo simulation, the Backtester, the Leak Map, the AI Coach, Hello Trader, Macro, COT, notes, voice dictation, CSV import and export, and a JSON backup of everything.
  • The widget, a desktop app for Windows only, included in Pro and Elite: session notes, a trade log, screenshots, a day log, daily rules with alerts and voice dictation. It also runs Autosync.

You can import your trades from a CSV file: today the import works with files from DeepCharts / Rithmic. On Pro and Elite, Autosync does it for you: while the widget is open, it reads the fill files that DeepCharts saves on your computer (the last seven days), rebuilds your trades and sends them to your journal. For now it works with DeepCharts only. The pricing page shows which features and limits come with each plan.

Who helps us run it

We run the service with a few providers. The Privacy policy says which data each one receives.

3. Your account

  • You must be 18 or older. The service is not meant for minors.
  • Use an email address that is yours. We use it to confirm your account, reset your password and send you notices about your plan and these terms.
  • One person, one account. Your account is personal: do not share it or let others use it.
  • Keep your credentials safe. Keep your password to yourself. If you share it or do not keep it safe, what is done with your account counts as done by you. If you think someone else got into it, write to us right away.

Signing up with email

You sign up with an email address and a password of at least 8 characters. We then send a confirmation link from noreply@deliriumoftraders.com: your account is ready once you open it. The Code and Community fields on the sign-up page are optional (section 7).

Signing in with Google

You can also sign up and sign in with “Continue with Google”. Google then gives us only your name, email address and profile picture, which we use to create and recognize your account. If your Google email is the same as the email of an account you already have, both ways of signing in lead to the same account: you do not end up with two journals. The widget accepts both ways too (Google from version 1.1.4).

You can remove our access at any time from your Google account permissions. To delete your account and your journal, use the option in the app (section 8).

News and offers

At sign-up there is a box, never ticked for you: “Send me occasional news and offers”. If you tick it, we will send you our newsletter (news, discounts and offers) from time to time, once it starts. You can stop it whenever you want, in Settings → Account → Newsletter or with the link in every newsletter email; your account works the same either way. How we handle this is in the Privacy policy.

4. Plans and the waitlist

There are three plans: Free, Pro and Elite. The features and limits of each are the ones shown on the pricing page.

  • Free is open now, with no time limit and no card required.
  • Pro and Elite are not on sale yet. You can join a waitlist with the “Join the Pro waitlist” and “Join the Elite waitlist” buttons on the pricing page: you create a free account and we note which plan you are waiting for. Being on the waitlist costs nothing and commits you to nothing: we charge you nothing, and you are free not to buy when the plan opens.
  • When your plan opens, we email you. You can leave the waitlist whenever you want in Settings → Plan, by writing to support@deliriumoftraders.com, or by deleting your account.
  • The prices on the pricing page are the ones we plan, and they may change before Pro and Elite open. The price that counts is the one shown when you buy.

Before we sell anything, we will publish updated terms covering prices, payment, automatic renewal, cancellation and, for EU consumers, the right of withdrawal. You will see them before you buy, and nothing is charged until you choose to buy.

5. Leaving, and moving back to Free

  • You can leave whenever you want: delete your account from the app (section 8).
  • If your Elite plan ends (for example the free Elite plan of section 7), your account moves to Free. Anything above the Free limits (extra accounts, setups and notes, for example) stays visible, read-only: you cannot edit or delete those items until you are on Pro or Elite again. Screenshots work differently: you still see all of them, but you cannot add new ones while you are above the Free limit. This limits the Free plan, not your rights over your personal data: you can still delete your whole account, or ask us at support@deliriumoftraders.com to correct or erase specific data (see the Privacy policy). The widget, Autosync and the other paid features are no longer available.
  • Nothing is deleted. Your trades and everything else stay in your journal, and you can still export all of it as a JSON file at any time.

6. Paid plans and the right of withdrawal

Pro and Elite are not on sale yet, so there is nothing to pay for. The Free plan costs nothing, and you can end it at any time, without giving a reason, by deleting your account (section 8). When they open, consumers in the European Union will have a 14-day right of withdrawal after buying, without giving a reason. How it works, with the model withdrawal form, will be in the updated terms you see before you buy (section 4).

7. Community and codes

Blood, Sweat & Scalp

Members of the Blood, Sweat & Scalp community get the Elite plan free: you sign up like everyone else, then verify your membership through Whop in Settings. It is the full Elite plan, the same one that will be sold when paid plans open, widget and Autosync included.

The free Elite plan lasts as long as you are a member and as long as our arrangement with the community exists. It is not a lifetime plan. If your membership ends, the free Elite plan ends with it. If the arrangement with the community ends, we tell you in advance. In both cases your account moves to Free, with the read-only rule of section 5: nothing is deleted, and you can join the Pro or Elite waitlist, or buy a paid plan once they open.

Codes

When you sign up you can enter a code, from a community or for a discount. Today a code does not give anything yet: it is saved with your account. In the future, codes may give discounts or free months. When they do: one code per purchase, codes cannot be combined, a code has no cash value, and a code may expire.

The Community field

The optional Community field only tells us which community you came from. We see it in our list of users.

8. Your content

Everything you write or import into your journal is yours, from trades and notes to screenshots, setups and what you dictate. We claim no ownership of it.

You give us only the permission we need to run the service for you: to store your content, show it to you, process it for the features you use and keep safety copies. We pay nothing for it and it is not exclusive, so your content stays yours to use anywhere else. It ends when you delete your content or your account, apart from the time needed to clear our backups (see the Privacy policy).

Who sees it

Your journal is visible to you and to no other user: no public pages, no leaderboard, no sharing of your trades. We do not sell your data, show ads or pass your data to brokers or prop firms. The AI features send the data they need to our AI provider, Groq, to write their answers. We look at your data only when it is needed to run the service: to solve a problem you reported, for security, or because the law requires it.

Export and deletion

You can export everything as a JSON file at any time, and there is a CSV export too. You can delete your account from the app whenever you want: your account and your journal are then removed from our database, and from our backups within the time stated in the Privacy policy. Everything is deleted right away, the history of versions and your screenshots included; we keep only your messages to support, for the time the Privacy policy states.

What you upload

You are responsible for what you put in your journal. Please do not upload other people’s personal data (for example a screenshot showing someone else’s name or messages), unlawful content or content you have no right to use. And do not write sensitive information, such as health data, in your notes: the journal is not made for it.

9. Acceptable use

Use the service for your own trading journal, and do not:

  • try to reach other users’ data or accounts, or parts of the service you are not meant to reach;
  • attack, overload or disrupt the service, or try to get around its security or your plan’s limits;
  • extract data with bots, scrapers or other automated tools, apart from the exports the app offers;
  • resell, rent or sublicense the service, or access to it;
  • abuse the AI features, for example by flooding them with requests or using them for things unrelated to your journal;
  • share your account;
  • upload malware or unlawful content, or use the service to break the law.

A serious breach of these rules can lead us to suspend or close your account (section 14).

10. The desktop widget

While you are on Pro or Elite (including Elite free through Blood, Sweat & Scalp), we give you a personal, non-exclusive, non-transferable license to install and use the widget on your own Windows computers, for your own journal. The license ends when your account moves to Free.

  • Where it comes from. The widget is downloaded from GitHub.
  • How it signs in. It connects directly to your account, with email and password or, from version 1.1.4, with Google.
  • What it reads. When you use Autosync, the widget reads the fill files that DeepCharts saves on your computer, and only those. It does not ask for your broker password, does not connect to your broker and never places orders.
  • Updates. We publish new versions from time to time. Keep the widget up to date: an old version may stop working with the journal.

11. Third-party platforms and prop firms

Delirium of Traders is not affiliated with or endorsed by the trading platforms, data providers and prop firms it works with or mentions. Their names are trademarks of their respective owners.

  • Import and Autosync depend on other companies’ files. They read the file formats of DeepCharts and Rithmic, which those companies can change at any time without telling us. If that happens, import or Autosync may not work until the app is updated to the new format. Your broker’s statements remain the official record of your trades. If a paid feature stays out of order because of such a change, your rights under section 17 still apply.
  • Prop firm rules change. The ready-made rule presets in the Prop Tracker and the news rules in Macro are summaries to save you time. Only your firm’s current rules count: always check them with your firm.
  • Market data comes from public sources. The app uses data from the CFTC (COT), FRED (economic data), Yahoo (prices), the Federal Reserve and the BLS. We send them nothing about you. We show the data as we receive it, and it can be late, incomplete or wrong.
  • Other services have their own terms. Google, Whop and GitHub apply their own terms and privacy policies to what happens on their side.

12. Not financial advice

Delirium of Traders is a journaling and analytics tool. It does not provide investment advice, trading signals or portfolio management, and nothing in the app or on the site is a recommendation to buy or sell anything. It analyzes trades you have already taken. It has no opinion on what the market is about to do, and it never will. We are not a broker and not a financial advisor.

  • AI answers can be wrong. The Coach’s summary, Hello Trader, the rule interpreter and voice dictation come from AI models, which can misread your numbers, miss something, or state something false with confidence. Check anything that matters to you.
  • The Monte Carlo is an estimate, not a prediction. It is a statistical simulation built on your own past trades: it shows how results could spread if your future trades looked like your past ones, and they may not. It is not a promise that you will pass or fail a challenge.
  • Trading futures involves substantial risk of loss and is not suitable for every investor. Past performance is not indicative of future results. The figures shown on the site are illustrative examples, not real trading results.

Your trading decisions, and their results, are yours alone.

13. Availability and changes to the service

We work to keep the service running, but like any online service it can sometimes be unavailable, have errors, or pause for maintenance and updates.

  • Features change. We add and improve features over time. We change or remove a feature only for a valid reason: to keep the service secure and working, to follow a change in the law or a decision of an authority, to adapt to changes by the platforms and providers we depend on (for example a new DeepCharts file format), or to develop the product. A change never costs you anything extra during a period you have already paid for.
  • If a change makes your paid plan worse in more than a minor way (for example, a main feature of the plan goes away), we tell you by email, reasonably in advance, what changes and when. You can then end your paid plan free of charge within 30 days of our email or of the change, whichever comes later, and we refund the part of the period you paid for and have not used.
  • If we ever shut the service down, we tell you in advance and give you time to export your data; for any period you have paid for and can no longer use, you get back the unused part, as the law provides.

None of this limits your rights under section 17.

14. Suspension and termination by us

We can suspend or close your account only for a serious breach of these terms, such as attacking the service, trying to reach other users’ data, reselling access or uploading unlawful content. Where possible, we warn you first and give you the chance to stop. When the breach puts the service or other users at risk, we can act right away, and we tell you why.

If we suspend or close your account and it turns out the breach was not your fault (for example, someone else got into your account and used it), we refund the unused part of any period you have paid for.

Closing your account does not take away your rights over your personal data: you can still ask us for a copy of your journal, or for anything else the Privacy policy describes, at support@deliriumoftraders.com.

15. Our intellectual property

The software of the web app and the widget, the design, the texts, and the Delirium of Traders name and logo belong to us or to those who licensed them to us. These terms let you use the service as they describe; they do not give you ownership of any part of it.

You may not copy, sell, modify, decompile or reverse-engineer the service, widget included, or use our name and logo, except where the law expressly allows it or we agree in writing.

16. Liability

Nothing in these terms excludes or limits our liability:

  • for intent (dolo) or gross negligence (colpa grave);
  • for harm to life or health;
  • in any other case where the law does not allow it, including the rights consumers cannot give up (Article 1229 of the Italian Civil Code; Italian Consumer Code).

The service records and analyzes your trades; it does not tell you what to trade (section 12). So your trading losses, and the results of your trading decisions, are not damage caused by us, even when you made those decisions while looking at the app’s statistics, the AI texts, the Monte Carlo, the prop firm presets or the market data. This does not limit your rights if the service itself does not work as agreed (section 17), or our liability in the cases listed above.

Keep your own copies: a JSON export from time to time is the simplest protection against anything going wrong, on our side or yours.

17. Your legal rights as a consumer

If you are a consumer, the legal guarantee of conformity for digital content and digital services always applies (Italian Consumer Code, Legislative Decree 206/2005, Articles 135-octies and following). If the service does not work as agreed, you are entitled to have it brought into conformity and, in the cases the law provides, to a proportionate price reduction or to end the contract. To report a problem, write to support@deliriumoftraders.com.

Nothing in these terms limits the rights that consumer law gives you and that cannot be waived. If a sentence here seems to say otherwise, the law wins.

18. Governing law and disputes

These terms are governed by Italian law.

  • If you are a consumer, you also keep the protection of the mandatory rules of the country where you live (Article 6 of Regulation (EC) No 593/2008, “Rome I”). You can bring a case before the court of the place where you live, and we can bring a case against you only there. For consumers in Italy this follows from Article 66-bis of the Italian Consumer Code, and for consumers elsewhere in the EU from Articles 17 to 19 of Regulation (EU) No 1215/2012.
  • If you are not a consumer (you use the service for your business), the court of the place where we are based has jurisdiction.

Before going to court, you can write to us: most problems are solved faster by email. You do not have to.

19. Changes to these terms

  • Material changes are made only for a valid reason: a change in the law, a decision of a court or authority, a change in the service (section 13) or in the providers we depend on, security, or new plans and features. We announce them by email at least 30 days before they apply, saying what changes, and we also show a notice in the app. If you do not agree, you can cancel your plan or delete your account before they apply. On a paid plan, changes that are less favorable to you apply from your next renewal, unless the law or the security of the service requires them sooner; in that case, you can end your plan before they apply and get back the unused part of the period you paid for.
  • Small changes that do not reduce your rights, like clearer wording or corrections, apply when we publish them.

The date at the top of this page shows when the terms last changed.

20. Languages

These terms are available in English and in Italian, with the same content. If the two versions ever differ, the reading most favorable to the consumer applies.
